Welcome to TradeTxT. These Terms of Service govern your use of our website and services operated by Fox & Pirate LLC. By using our website or services you agree to these terms. Please read them carefully before signing up.

1. About the Service

TradeTxT provides an automated missed call SMS service for home service businesses. When a customer calls your business and you are unable to answer, TradeTxT automatically sends a customized SMS response to the caller on your behalf.

The service works by forwarding unanswered calls to a dedicated TradeTxT phone number assigned to your account. This requires you to set up call forwarding on your mobile phone, for which we provide instructions.

2. Eligibility

You must be at least 18 years old and a registered business operator to use TradeTxT. By signing up you confirm that you are authorized to enter into this agreement on behalf of your business.

The service is currently available to businesses operating in the United States only.

3. Account Registration

When signing up you agree to provide accurate and complete information including your name, business name, email address, mobile phone number and mobile carrier type.

You are responsible for keeping your account information up to date. Inaccurate information may result in service disruption or account termination.

4. Call Forwarding and Service Activation

TradeTxT requires you to activate call forwarding on your mobile phone to your assigned TradeTxT number. We provide step-by-step activation instructions via SMS and email upon signup.

You are solely responsible for correctly setting up and maintaining call forwarding on your device. TradeTxT is not responsible for missed calls or undelivered messages resulting from incorrect or incomplete call forwarding setup.

Please note: When call forwarding is active, your standard voicemail service will typically be bypassed. TradeTxT replaces voicemail with an automatic SMS response to your callers. If you deactivate TradeTxT you should verify that your voicemail has been restored by your carrier.

5. SMS Communications

By using TradeTxT you agree that:

  • Automated SMS messages will be sent to your callers on your behalf
  • You are responsible for ensuring that your use of the service complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA)
  • You are responsible for obtaining any required consent from your customers to receive SMS messages
  • Standard messaging rates may apply to messages sent and received

To stop receiving SMS messages from TradeTxT, reply STOP to any message or contact us at info@tradetxt.com.

6. Acceptable Use

You agree to use TradeTxT only for lawful business purposes. You may not use the service to:

  • Send spam, unsolicited messages or misleading communications
  • Harass, threaten or harm any individual
  • Violate any applicable local, state, national or international law or regulation
  • Impersonate any person or business
  • Interfere with or disrupt the service or its infrastructure

We reserve the right to suspend or terminate your account immediately if we determine that you are using the service in violation of these terms or applicable law.

7. Payments and Subscriptions

TradeTxT is offered as a monthly subscription service. By subscribing you agree to the following:

  • Subscription fees are charged monthly in advance
  • Your subscription will automatically renew each month unless you cancel before the renewal date
  • All fees are clearly disclosed at the time of purchase
  • Payments are processed securely by Stripe
  • We do not store your payment card details

Cancellations: You may cancel your subscription at any time by contacting us at info@tradetxt.com. Cancellation takes effect at the end of the current billing period. We do not offer partial refunds for unused portions of a billing period unless required by applicable law.

Failed payments: If a payment fails we will attempt to notify you by email. Continued failure to pay may result in suspension or termination of your service.

8. Service Availability

We strive to provide a reliable and uninterrupted service but we do not guarantee that the service will be available at all times. The service may be affected by factors outside our control including carrier network issues, device compatibility and regulatory changes.

We may modify, suspend or discontinue any part of the service at any time. Where possible we will provide advance notice of significant changes.

9. Carrier Compatibility

TradeTxT is compatible with GSM networks (including AT&T, T-Mobile and their associated networks) and CDMA networks (including Verizon and their associated networks). Compatibility cannot be guaranteed for all devices, carriers or network configurations.

If you are unsure of your carrier type, we provide guidance during signup. If the service does not work with your carrier, contact us at info@tradetxt.com and we will do our best to assist you.

10. Intellectual Property

All content, branding, software and materials associated with TradeTxT are the property of Fox & Pirate LLC and are protected by applicable intellectual property laws. You may not copy, reproduce or distribute any part of the service without our express written permission.

11. Limitation of Liability

TradeTxT is provided “as is” without warranties of any kind, either express or implied. To the fullest extent permitted by law, Fox & Pirate LLC is not liable for:

  • Lost business opportunities or revenue
  • Missed calls or undelivered messages
  • Failure of call forwarding due to carrier or device issues
  • Any indirect, incidental, special or consequential damages arising from your use of the service

Our total liability to you for any claim arising from your use of TradeTxT shall not exceed the amount you paid us in the 30 days preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Fox & Pirate LLC, its officers, employees and agents from any claims, damages, losses or expenses (including legal fees) arising from your use of the service, your violation of these terms, or your violation of any applicable law or third party rights.

13. Privacy

Your use of TradeTxT is also governed by our Privacy Policy, available at https://tradetxt.com/privacy-policy. By using the service you agree to the collection and use of your information as described in the Privacy Policy.

14. Changes to These Terms

We may update these Terms of Service at any time. We will notify you of significant changes by email. Your continued use of the service after changes are posted constitutes your acceptance of the updated terms. If you do not agree to the updated terms you should cancel your subscription and stop using the service.

15. Governing Law

These Terms of Service are governed by the laws of the State of Wyoming, United States, where Fox & Pirate LLC is registered. Any disputes arising from these terms shall be resolved in the courts of Wyoming.
